PETITION FOR REVIEW Comes now the Plaintiff/Petitioner, Jane Hancock, by her attorney, James Wilson Douglas, pursuant to West Virginia Code 48A-4-17(a), and in and for her Petition For Review, heretofore filed within ten (10) days after the Family Law Master's Recommended Findings Of Fact And Conclusions Of Law, made and entered herein on or about April 11, 1993, and consistent with the form prescribed by West Virginia Code 48A-4-18, does assign and complain of the following exceptions thereto: STATEMENT OF QUESTIONS 1. That the Recommended Order of the Family Law Master, regarding the identification of Plaintiff's real estate as marital property, and its inclusion in a scheme of equitable distribution herein, is contrary to the law and the facts of the case, and is violative of legislative intent and public policy. 2. That the Recommended Order of the Family Law Master, concerning the disposition of personalty, which were marital assets of the Parties hereto, is contrary to the law and the facts of the case, and is violative of legislative intent and public policy. 3. That the neglect, refusal and failure of the Family Law Master to grant the Plaintiff an award for homemaker services, especially when Plaintiff's request and corroborative testimony was unrebutted, is inconsistent with the facts of this case and flies in the face of statutory provisions therefor. 4. For such other errors apparent on the face of the record. ARGUMENT Authority for question number 1: West Virginia Code 48-2-15 and 48-2-32; Authority for question number 2: Id. Authority for question number 3: Id. PRAYER Wherefore, Petitioner prays that the Court review the proceedings and recommended decision of the Master; that the Court recommit the case with instructions, consistent with a favorable review of the questions stated by the Petitioner, for further hearing before the Master; or that the Court, in its discretion, enter an Order granting the Petitioner redress for the questions herein set forth, and for such other relief as the demands of justice may require.
